For a Fortune 500, sure. For a startup, the risk is negligible compared to the cost savings. We use Midjourney for everything and will deal with the legal precedent when it's actually set.

That's a common startup stance, but it becomes a major issue during due diligence if you try to get acquired. IP contamination is a real dealbreaker.
